Terms of Use
These Terms govern your use of Love Present (the "Service"). By creating a gift page you confirm that you have read, understood and agree to be bound by everything set out below. Version in force: 2026-09-06.
1. Who provides the Service
The Service is owned and operated by Love Present — Nguyễn Công Trình. For anything concerning an order, a refund, or the content of a gift page, write to nguyencongtrinhltqb@gmail.com. A person receives and answers it; there is no automated call centre.
2. Who may use the Service
You must have the legal capacity to enter into these Terms under the law of the place where you live. If you are under eighteen, you may use the Service only with the consent of a parent or legal guardian. The Service is not intended for children under thirteen and we do not knowingly collect data from children below that age. You are responsible for keeping your account password confidential and for activity carried out through your account.
3. Your rights and responsibilities for the content you upload
You keep all intellectual property rights in the photos, text, music and video you place on a gift page (the "Content"). We claim no ownership of the Content. You grant us a non-exclusive, royalty-free and revocable licence, limited to storing, technically reproducing and displaying the Content to whoever opens the link, for the sole purpose of operating the Service; that licence ends when the gift page is deleted. You warrant that you hold the rights you need: the photos are yours or the people in them have agreed; the song is yours or you are permitted to use it on a private page of this kind; the video is one you filmed or are entitled to use. The person who uploads the Content is the person responsible for it.
4. Confirming rights to music and video
Each time you attach music or a video to a gift page you must tick the box confirming that you hold the rights to use it — a separate confirmation for each. That confirmation is recorded at the moment the page is created, together with the version of these Terms then in force, so that a rights complaint can be answered on the record. Using a commercial film or a music video you do not hold the rights to is not permitted on the Service.
5. What you must not do
In using the Service you must not: upload content that breaks the law, infringes the rights of others, or is pornographic, hateful, harassing or threatening; use the Service to harass, track or pressure an individual; upload malicious code or anything else harmful to the system; gain unauthorised access to another person's account or gift page; enumerate page codes by automated means; or use the Service in a way that disrupts its normal operation. We may suspend an account and remove an infringing gift page under clause 7.
6. What we record when you make a gift page
For each gift page created, we store the version of these Terms you agreed to and when you agreed; if the page carries a song, when you confirmed the rights to it; if the page carries a video, when you confirmed the rights to that. For a paid page we store one further timestamp and only one: the moment somebody other than you first opened it, so that we can establish whether the gift has been delivered for the purposes of a refund. We do not store IP addresses and we do not store the identity of the person who opened it. Pages created before these Terms took effect carry none of that record, and we do not add it retrospectively, because recording a consent that was never given is not acceptable. 7. Suspension and removal of a gift page
We remove a gift page on a substantiated rights complaint, or where the content breaks the law. Removal is permanent: the record and its files are deleted, and the link returns a blank screen that gives no reason and names no complainant. We can end the hosting, but we cannot recall copies that have already spread beyond the Service, including screenshots, downloaded files and third-party caches.
8. Payment and refunds
Each gift page is paid for once. There is no subscription and no account to maintain. While nobody has opened the link you may change your mind and receive a full refund. If you were charged and the link did not work, we refund in full, even where the recipient has opened it. The Refund Policy sets out each case in detail.
9. Reporting a violation
If a gift page uses a photo, a song or other content you hold the rights to, or carries content that is not permitted, send us the link to that page. Reporting does not require an account.
10. Limitation of liability and disclaimer of warranties
The Service is provided on an as-is basis. To the extent permitted by law, we do not warrant that the Service will be uninterrupted or free of errors, nor that a link will remain reachable indefinitely. We are liable for direct loss caused by our own fault, but in every case our total liability in respect of a gift page does not exceed the amount you paid for that gift page. We are not liable for indirect loss, for loss of data of which you kept no copy, or for loss arising from your passing the link to another person. This limitation does not exclude liability that the law does not permit to be excluded, including liability for wilful misconduct or fraud. Your refund rights under clause 8 are not limited by this clause.
11. Governing law and disputes
These Terms are governed by the law of Vietnam. Before bringing a claim, both parties will attempt to resolve the dispute by negotiation through the contact address given in clause 1. If no agreement is reached, the dispute is to be settled by the competent court under the law of Vietnam. If you are a consumer resident outside Vietnam, this clause does not deprive you of the protection of the mandatory rules of the law where you live. For payments by international card, Paddle is the merchant of record and Paddle's own terms also apply to that transaction.
12. Effect, amendment and severability
These Terms take effect in the version 2026-09-06 shown at the top of this page. Where something changes, we amend it here and change the version number. A gift page you have created is governed by the version in force when it was created, which is stored with that page's record under clause 6; amendments do not apply retrospectively. If an amendment narrows your rights, we notify the email address on your account before it takes effect. If any provision is held to be invalid, the remaining provisions continue in force.
